1. Introduction
These Terms and Conditions govern your use of our gardening services provided by Gardener Clapham. By engaging our services, you accept these terms in full.
2. Definitions

- Client: The individual or entity purchasing gardening services.
- Agreement: The contract between the Client and Service Provider.
3. Services Offered
We offer a range of gardening services including but not limited to:
- Garden maintenance
- Landscape design
- Planting and pruning
- Weed control
- Fertilization
3.1 Custom Services
Customized gardening solutions are available upon request. Additional charges may apply based on the complexity and materials required.
4. Booking and Scheduling
Bookings can be made through our online portal or by contacting our office. We strive to accommodate your preferred schedule; however, availability cannot be guaranteed.
4.1 Cancellation Policy
Clients may cancel or reschedule services up to 24 hours in advance without incurring fees. Cancellations made less than 24 hours before the scheduled service may be subject to a cancellation fee.
5. Payment Terms
Payment is due upon completion of services unless prior arrangements have been made. We accept various payment methods including cash, credit/debit cards, and bank transfers.
5.1 Late Payments
Late payments may result in the suspension of services until the outstanding amount is settled. Interest may be charged on overdue invoices as per applicable laws.
6. Client Responsibilities
Clients are expected to provide access to the property and ensure that it is safe for our staff to perform their duties. Any potential hazards should be communicated in advance.
6.1 Property Access
Clients must ensure that all necessary areas are accessible and that pets are secured during service times to prevent any accidents.
7. Liability Limitation
While we strive to provide high-quality services, Gardener Clapham is not liable for any indirect, incidental, or consequential damages arising from the use of our services.
7.1 Insurance
We maintain appropriate insurance coverage to protect against potential damages during service delivery. Clients are advised to notify us of any existing property issues prior to service commencement.
8. Termination of Service
Either party may terminate the Agreement with written notice if the other party breaches any material term of these Terms and Conditions. Upon termination, any outstanding payments must be settled promptly.
8.1 Immediate Termination
Gardener Clapham reserves the right to terminate services immediately if a client engages in behavior that is deemed unsafe or abusive.
9. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of the jurisdiction in which Gardener Clapham operates. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the local courts.
9.1 Dispute Resolution
In the event of a dispute, both parties agree to seek amicable resolution through negotiation before pursuing legal action.
10. Amendments to Terms and Conditions
Gardener Clapham reserves the right to amend these Terms and Conditions at any time. Clients will be notified of any significant changes, and continued use of our services constitutes acceptance of the updated terms.

11. Intellectual Property
All content provided by Gardener Clapham, including but not limited to text, images, and logos, is the property of the company and is protected by applicable intellectual property laws. Unauthorized use is prohibited.
11.1 Use of Materials
Clients are granted a limited license to use materials provided for personal, non-commercial purposes. Redistribution or modification of materials is not permitted without prior consent.
12. Privacy Policy
Your privacy is important to us. We collect and process personal data in accordance with our Privacy Policy, which is incorporated into these Terms and Conditions by reference.
12.1 Data Protection
We implement appropriate security measures to protect your personal information from unauthorized access, alteration, or disclosure.
13. Force Majeure
Gardener Clapham is not liable for any failure to perform services due to causes beyond our reasonable control, including but not limited to natural disasters, pandemics, or governmental actions.

In the event of a force majeure, we will notify clients as soon as possible and make reasonable efforts to reschedule services.
14. Severability
If any provision of these Terms and Conditions is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining terms will remain in full force and effect.
14.1 Entire Agreement
These Terms and Conditions constitute the entire agreement between the client and Gardener Clapham regarding the use of our services and supersede all prior agreements and understandings.
15. Acceptance of Terms
By engaging Gardener Clapham's services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
